We hereby inform you in a transparent manner about the functioning of the so-called cookies on this website (hereinafter also referred to as the “Website”).

Definition of “Cookies”

Cookies are small text files sent from the Website to the user’s terminal (usually the browser), where they are stored before being re-transmitted to the Website upon the next visit of the same user. A cookie cannot retrieve any other data from the user’s hard disk or transmit computer viruses or acquire email addresses. Each cookie is unique to the user’s web browser. Some of the functions of cookies can be delegated to other technologies. The term “cookie” refers to cookies and all similar technologies.


Processing purposes and objectives of technical session cookies

The cookies used on the Website have the purpose of performing IT authentications or monitoring sessions and storing specific technical information regarding users accessing our servers. In this perspective, some operations on the Website could not be performed without the use of cookies, which in such cases are therefore technically necessary. By way of example, access to restricted areas of the Website and the activities that can be carried out there would be much more complex to carry out and less secure without the presence of cookies which allow the user to be identified throughout his/her session.

Pursuant to Art. 122, par. 1 of Legislative Decree no. 196 of 30 June 2003, as integrated and amended via Legislative Decree no. 101 of 10 August 2018, “technical” cookies may be used also without the consent of the interested party. Among other things, the same European body that brings together all the privacy authorities of the various Member States (the so-called “Article 29” Group), now EDPB, has clarified in Opinion 4/2012 (WP194) called “Exemption from consent for the use of cookies” that the cookies for which it is not necessary to acquire the prior and informed consent of the user are:
1) cookies with data compiled by the user (session identifier), for the duration of a session or persistent cookies limited to a few hours in some cases;
2) authentication cookies, used for the purposes of authenticated services, for the duration of a session;
3) user-centric security cookies, used to detect authentication abuse, for a limited persistent duration;
4) session cookies for media players lasting a session;
5) session cookies for load balancing, for the duration of a session;
6) persistent cookies for customizing the user interface, for the duration of a session;
7) cookies for sharing content through third-party social plug-ins, for members of a social network who have logged in.

ICE-Agenzia thus informs that technical cookies necessary for browsing the Website are operational on the same Website, since they allow essential functions such as authentication, validation, management of a browsing session and fraud prevention.

For maximum transparency, a series of technical cookies is listed below:

  • Cookies implanted directly in the user/contractor’s terminal (which will not be used for other purposes) such as authentication cookies, cookies for multimedia content such as media players that do not exceed the duration of the session, etc;
  • Cookies used to statistically analyse accesses/visits to the website (so-called “analytics” cookies), which pursue exclusively statistical purposes (and not also profiling or marketing) and collect information in aggregate form without the possibility of tracing the identification of the individual user. In these cases, since current legislation requires that for analytics cookies the interested party is provided with clear and adequate indication of the simple ways to oppose (opt-out) from their installation (including any anonymity mechanisms of the cookies themselves), it is hereby specified that it is possible to change the cookie settings.


Third-Party Cookies

While browsing the website, the user could also receive cookies from different sites or web servers on his/her terminal (so-called “third-party” cookies): this happens because elements such as, for example, images, maps, sounds, specific links to web pages of other domains that reside on servers other than the one on which the requested page is located may be present on the site. Therefore, these cookies are set directly by website managers or servers other than the Website. These cookies can be sent to the user’s browser by third-party companies directly from their websites, which can be accessed by navigating from the ICE-Agenzia website. In such cases, ICE-Agenzia is unrelated to the operation of these cookies, the sending of which falls under the responsibility of these third-party companies. As clarified by the Data Protection Authority: “The obligation to inform the user about the use of cookies and possibly acquire the prior consent lies with the manager of the website that uses them, as data controller. In the event that a website also allows the transmission of “third-party” cookies, the information and the acquisition of consent are usually the responsibility of the third party. It is necessary for the user to be adequately informed -albeit with the simplified procedures established by law- when he/she accesses the website that allows the storage of third-party cookies, or when he/she accesses content provided by third parties and, in any case, before the cookies are downloaded on his/her terminal”. He/she also has the right to portability, i.e. to receive the personal data provided by the interested party in a structured format, commonly used and readable by an automatic device.
