NATIONAL NOTARIES COUNCIL OF THE UNITED DISTRICTS OF ROME, VELLETRI AND CIVITAVECCHIA – 2ST PUBLIC AUCTION


National Notaries Council of the united districts of Rome, Velletri and Civitavecchia

The auction shall take place on 20 Semptember 2023, via online procedures through the Notarial Auction Network of the Notaries National Council.

The National Notaries Council of the united districts of Rome, Velletri and Civitavecchia (hereinafter also referred to as the “NNC of Rome, Velletri and Civitavecchia”) holds for sale the ownership of two real estate units:

  • As set out in the minutes of meeting no. 2738 of the NNC of Rome of 1 June 2022, it is the Institution’s intention to proceed with the sale of its assets through public tendering procedures also with the online notary auction system of the National Notaries Council called “RAN”;
  • Single lot, composed by the following two residential real estate units:        
  • Second-floor apartment, apt. no. 2, with appurtenant cellar in the basement, recorded in the NCEU (New City-Property Registry)  of the Municipality of Rome, in foglio 491, p.lla 176, sub. 10, census area 2, category A/2, class 4, 8.5 compartments, Cadastral Revenue € 2,941.22 
  • Second-floor apartment, apt. no. 3, recorded in the NCEU (New City-Property Registry) of the Municipality of Rome, in foglio 491, p.lla 176, sub.  25, census area 2, category A/2, class 4, 3 compartments, Cadastral Revenue € 1,038.08.

 

The Auctions shall be carried out for the Single Lot, constituted by more real estate units inclusive of any eventual adjacencies and pertinencies. The Lots List -fully documented -, the List of Notaries to whom bids may be submitted, this Full Notice of Public Auction as well as the Book of Auctioning Conditions and its Annexes (facsimile participation Forms) regulating the auction’s participation modalities and structure are made available on the websites of the National Notaries Council (www.notariato.it/ran and www.avvisinotarili.notariato.it) with the Auctioneers.

The information related to the lot may be updated or amended via specific publication on the aforementioned websites, and it is the duty of each Bidder to review said eventual updates before submitting his/her bid.

The lot shall be held for sale in its totality, as found in fact and in law, together with any pertinence, existing facility and positive and negative easement where applicable.

 

The NNC of Rome, Velletri and Civitavecchia hereby prohibits the duplication via any means of the publications of either the auction or the single lot to which it refers, as well as the dissemination of the relevant documents for commercial purposes, not recognizing the intermediation activities of third parties and reserving the right to call upon the competent authorities should this prohibition be violated.

 

Type of Auction

 

The Auction entails the submission of paper, digital or digitalised paper Sealed Bids to the Auctioneer/Secondary Notary (the Notary certified to access the Notarial Auction Network, as listed in the websites www.notariato.it/ran and www.avvisinotarili.notariato.it), for an amount at least equal to the basic Auction price indicated in the Lot List. In the event of a single valid Sealed Bid, the lot shall be sold to the bidder who submitted said valid Sealed Bid. In the event of multiple valid Sealed Bids, the auction between the bidders who submitted the two (in the event of only two bids) or three (in the event of three or more bids) highest bids, including all eventual ex aequo, including both the highest bid and the second and third ones, pursuant to the conditions set forth in point 4.3 of the Book of Auctioning Conditions. The auction between legitimate bidders consists in the presentation, before the Auctioneer or the Secondary Notary to whom the Bid was submitted, of Open Bids of increasing value if compared to the highest valid Sealed Bid, with a minimum raised bid of € 1,000.00.

Guarantee Deposit

In order to guarantee the Bid, participants in the Auction must, under penalty of exclusion, lodge a deposit in favour of the NNC of Rome, Velletri and Civitavecchia for an amount equal to 10% of the basic auction price as reported in the summary list of lots published on the website www.notariato.it/ran

The Guarantee Deposit shall be provided, under penalty of exclusion, either via bank draft issued by a credit institution or via equivalent postal cheque with non-transferability clause made out to “Consiglio Notarile di Roma”.

The Guarantee Deposit must be submitted to the Notary (Auctioneer or Secondary) to whom the Bid was submitted.

 

Deposit Integration and Substitution

In order to integrate the deposit, the Successful Bidder shall carry out a payment equal to 10% of the Plot’s Award Price within the essential term of fifteen calendar and consecutive days from the final award, under penalty of award revocation and final forfeiture of the initial Guarantee Deposit.

This payment shall be made out to the following IBAN via bank or postal transfer with “Payment of Second Deposit for lot no. ” as reason for the payment, together with the name and surname of the Successful Bidder: IT19 R056 9603 2270 0000 2700 X08, made out to “Consiglio Notarile di Roma”.

The cheque shall be hand-delivered to the Auctioneer or the Secondary Notary to whom the Guarantee Deposit was delivered, or submitted to the same via certified e-mail within 15 days starting from the date of the final award. Upon receiving the bank transfer, the Auctioneer or the Secondary Notary shall give notice to the NNC of Rome, Velletri and Civitavecchia via certified e-mail (consiglioroma@postacertificata.notariato.it) and regular e-mail (consiglioroma@notariato.it) and, upon receiving the Institution’s confirmation, he/she will return the bank draft of the initial deposit back to the Bidder.

 

Sales Agreement

The Sales Agreement between the NNC of Rome, Velletri and Civitavecchia and the Successful Bidder may be drafted by the Notary (Auctioneer or Secondary) to whom the Bid was submitted, or by a Notary to be selected and appointed on the day of the final award. The closure of the Sales Agreement, in the interest of the NNC, shall take place within the essential term of 90 calendar and consecutive days from the final award.

Fees and Expenses

 

Expenses shall be borne in full by the Successful Bidder as laid out in point 8 of the Book of Auctioning Conditions, including the Notary’s fee for the creation of the Auction Report.

In the event of the award, the fee for the creation of the Auction Report by the Auctioneer shall be quantified, with regard to the complexity of such document, up to a maximum amount of € 1,800.00 plus VAT; moreover, for each lot assigned, the Successful Bidder shall also pay to the Auctioneer the expenses incurred by the latter for the management of the online auctioning procedure, to be determined at € 340.00 plus VAT.

Moreover, the expenses and taxes related to the Auction Report such as, by way of example, the expenses for stamps, accessories, taxes, duties and other fees, shall be borne too by the Successful Bidder. The aforementioned fees and taxes are to be fully borne by the Successful Bidder.

Considering that the sales agreement may be signed also by the Notary (Auctioneer or Secondary) to whom the Bid was submitted, each Bidder shall have the right to request, upon submitting the Bid, a rough estimate of the fees to be paid, pursuant to Art. 9 of Legislative Decree no. 1 of 2012, converted into Law no. 27 of 24 March 2012. The Bid may be submitted, then, to the Notary chosen by the Bidder, who may also be the one tasked with the eventual subscription of the purchase agreement for the awarded lot. For additional consultancy or other complementary support services, other fees may be requested, which will be agreed upon approval of the relative quotation.

 

Body’s Rights and Powers

Pursuant to point 5 of the Book of Auctioning Conditions, the NNC of Rome, Velletri and Civitavecchia shall reserve the power to amend, suspend and/or terminate the auction and awarding procedures at any time up to the signature of the agreement, for motivated reasons, and the Bidder or the Successful Bidder shall not be entitled to make any claim against it, notwithstanding, in the event of the termination of the auction or of the awarding procedures, the obligation to reimburse the Deposits made as mentioned in points 3.1 and 4.5, as well as the expenses borne pursuant to the Book of Auctioning Conditions, point 8. The Bidders or the Successful Bidder shall not be entitled to make any claim against the NNC of Rome, Velletri and Civitavecchia for lost profits and/or for the costs borne for the submission of the Sealed Bid.

 

t is noted that the online procedure allows for both the usual submission of a sealed envelope and the submission of a digital or digitalised bid in accordance to the procedures set forth in the current Book of Auctioning Conditions, and that in order to partake in the Auction, the bid’s deposit must be completed upon prior appointment and within the terms set forth in the Plots List, before the Auctioneer or one of the Secondary Notaries listed officially on the official website of the Notaries National Council (www.notariato.it and www.avvisinotarili.notariato.it).

Bids shall be submitted to the Notary (Auctioneer of Secondary) by 19 September 2023.
